These Terms & Conditions (“Terms”) govern your use of the NamCab application and services. By creating an account or using NamCab, you agree to these Terms. NamCab is operated in the Republic of Namibia. Separate partner terms apply to drivers and transport providers.

Important — please read

NamCab is a marketplace and technology platform. We connect you with independent third-party service providers — we do not ourselves provide transport, delivery or any trip. When you book, the contract for that service is directly between you and the provider; NamCab is not a party to it. Drivers, transfer companies, carpool and churchpool hosts are independent contractors — not employees, agents, or partners of NamCab, and they are responsible for the services they provide.

1. The service & our role (marketplace)

NamCab is a technology marketplace that connects riders with independent drivers and accredited transport providers for rides, airport and intercity transfers, school transport (Schoolpool), carpooling, church-lift sharing (Churchpool) and parcel delivery. NamCab is not a transport operator, carrier, or employer. The trips, transfers and deliveries are performed by independent third parties who set their own conduct and use their own vehicles. Any contract for a trip is formed directly between you and that independent provider; NamCab acts only as an intermediary that facilitates matching, communication and (where applicable) payment.

The independent providers are not employees, agents, sub-contractors or representatives of NamCab, and nothing in these Terms creates an employment, agency, joint-venture or partnership relationship between NamCab and any provider or rider.

2. Your account

You must provide accurate information, keep your account secure, and be at least 18 years old (or have guardian consent). You are responsible for activity on your account.

3. Fares and payments

Fares are shown in Namibian Dollars (NAD) and are VAT-inclusive where applicable. On-demand fares are estimated before you book and finalised on the actual trip. Transfers and subscriptions are fixed-price. You agree to pay all fares, fees and charges for services you request.

4. Rider conduct and safety

Treat drivers and vehicles with respect, wear a seatbelt, and do not request unlawful trips. For Schoolpool, you confirm you are the guardian of the child and consent to their transport. Report safety concerns using the in-app safety tools.

5. Carpool & Churchpool

Carpool and Churchpool are cost-sharing arrangements between community members, not commercial transport. Hosts offer spare seats in their own vehicles and contributions are limited to sharing costs. NamCab only facilitates matching and charges a small facilitation fee. Hosts and riders participate at their own discretion and risk.

6. Limited liability

Because NamCab is a marketplace and not the provider of the trip, and to the fullest extent permitted by Namibian law, NamCab provides the platform “as is” and is not liable for the acts, omissions, conduct, negligence, road-worthiness or performance of the independent drivers, hosts or providers, nor for any loss, injury, death, delay or damage arising from a trip, which is the responsibility of the provider performing it. NamCab is not liable for any indirect, incidental, special or consequential loss arising from your use of the platform. Nothing in these Terms excludes liability that cannot lawfully be excluded (including liability for death or personal injury caused by our own negligence, or fraud). Where NamCab’s liability cannot be excluded, it is limited to the greater of the platform fee we earned on the trip in question or N$1,000.

You acknowledge that you use independent providers at your own risk and that any dispute about a trip is between you and that provider — though we will help mediate through our support and disputes process.

7. Indemnity

You agree to indemnify NamCab against claims, losses and costs arising from your breach of these Terms or your misuse of the service.

8. Suspension

We may suspend or close accounts that breach these Terms, our safety standards, or applicable law.

9. Governing law

These Terms are governed by the laws of the Republic of Namibia, and you submit to the jurisdiction of the Namibian courts. Consumer rights under Namibian law are not affected.
